I got copied!

*Ahem* I mean a crafter was perhaps inspired by my costumes and went off to design something similar... Or maybe it was just coincidence that she happened to design a headband, with cowrie shells, one of the exact India jewelry pieces I've put in a cascade before, and with flowers and hair falls positioned exactly where I position them on my headband hairpiece. Wait - WHAT?! I see corset pants in her ebay store. Oh my god - that's a macrame belt...

But *SNIFF!* She's selling it all way cheaper than me... and... I am terribly terribly sorry.

I'm sorry Melodia, for rolling my eyes at that post where someone was looking for melo-knockoffs and you posted with a link to the originals. I'm sorry Tempest, for the deepest darkest part of myself where I didn't sympathize with you for all the non-Tempest made corset belts on the market. I'm sorry Mom, remember the time I was out till 2 and I told you I was hanging out with a bunch of friends from church? Wait, I probably don't want to own up to that one quite yet...

Anyhoo, I just wanted to tell all of you knocked off designers out there that I now understand how you feel! I'm reading the description, and I see that she wraps her wire headband in satin ribbon (that would make it so much softer on the head) and it looks like she uses more kinds of yarn than me and more flowers, and the india jewelry dangling from the cowrie shells is really a great idea... And I almost want to buy it just so I can see if she wraps the stuff on with wire like me, or if the flowers are reinforced on their stems...

And the macrame belt is way better than mine - it's got 10 kinds of yarn and cowrie falls and better tassels... sniff sniff... And the corset pants - okay, nope, the corset pants don't compare to mine. Mine fit better and have bigger grommets and are fuller in the hem. Slight sigh of relief, but still, aaaaauuurrrrgh!!

So I'd like to give a shout out to anyone who creates or is thinking of creating a knock off design. Please know that somewhere in the belly dancing universe the designer you've ripped off is a person, and that person was much much happier when their designs were ORIGINAL!

I'm tempted to contact her and tell her I have plenty of designs I haven't made yet and probably will never have time to make - would she perhaps like to create some of them instead so that that way only her and I know that she is a sad individual with little creativity?

And now, as I can see this going downhill quickly, I shall sign my whiny self off to get some work done today!

That's her ebay store! I actually don't have anything on ebay at the moment - I forgot to post Sunday. I'm gonna try to always post my ebay stuff every week from now on. UGH!

SERIOUSLY?! wow... thats just not cool... trademark EVERYTHING!!!! that was if people are selling your designs and didnt get permission from you, you can take legal action

yeah.. if you don't have a trademark you can be screwed. Tempest sells her patterns for ppl to make them for themselves, but in hopes that ppl do not sell them. Once you have a pattern out there... you are bound for this to happen.

There are always going to be knockoff's out there. No matter how angry you get, remember that is what you designed, it may not be the best quality, but you will and your regular costumers come back loyally.

That is why I took my cosumes off of tribe over a year ago. Costumes I designed for mself. As a Dancer from CA very well told me she was getting ideas to copy my own designs. I also have been sewing like crazy (one of a kind my own creativity) but refuse to put stuff on line like Ebay. I will wait for enough cash to legalize my store, make labels , web site, opon a store front or sell privately..... Because some people do not have their own creativity . I been dancing over 20 years(Go-Go/professona) and been designing my own costumes since. Get labels, patent or copy write you designs.

Hmm... From the research I've done I thought you couldn't copyright clothing designs, since they're considered "useful articles" but does anyone know anything more about it than me?

So sorry this has happened to you!
I'm so sorry to hear this has happened to you! I can completely relate to it - I've had my share over the years of people stealing stuff from Shira.net and posting it on their own web sites, with never the slightest acknowledgement that I was the source. Those of us who are creative are doomed to be ripped off by those who don't have a creative bone in their own bodies.

I contacted her on ebay and heard back - she is claiming to not have ripped off my designs! She says a client gave her the design... Whatever...

Ok here are 2 ways to protect your designs(somewhat)
Get a flash HTML code put on your web site. This way when people try to right click and save. They cant.
Another way is if you get labels made for you to sew nto your arments. With your name or store name by you(name)

This is what I will be doing before I sell my designs. I am just waiting for the time I have to design the labels and hangtags itself. There is ls also www.etsy.com for one of a kind designs and you can have your own store front for alot cheaper then ebay!

Update
You won't believe what I just found out! Apparently it isn't the lady's fault. She's actually really torn up about it. Apparently one of my customers brought a pair of corset pants, a macrame belt, and a headband hairpiece to her and asked her to create more for their troupe, then went on to suggest that she put some up on ebay. And the best part is, due to the area and the exact piece of india jewelry that I saw in one of her headbands, I know which customer did this to me!

I think the ebay lady is going to work with me though. She actually seems pretty nice. Yay!

Well at least the issue is resolved but holy crap! That's not right what the other person did.....I hope things don't get out of hand.
