The man charged with the shooting deaths of a father and his two sons (one son died later in the hospital), was in Police custody on weapon charges, facing jail time, until KAMALA HARRIS (San Francisco District Attorney) decided to not press charges, yet again.  &#xD;
&#xD;
Why is this city unable to get tough on crime?  It's simple... none of these thugs live on the hill with Gavin and Kamala for neighbors.  They thrive in the Mission, the Excelsior and pretty much any neighborhood away from where the city's wealthy reside.   Our mayor in his infinite wisdom, chooses to waste millions on a "Dial 311 system" so the homeless and illegal immigrant population can find all the city resources available to them as well as a swoopy new "sonic gun shot locator" (hint; wherever the bleeding victim is- that's where the shooting took place).&#xD;
&#xD;
This city better shape the fuck UP.  We need to kick out these idiots appointed by a drunken whoring mayor.  It's time we had a DA that lets our Police do their jobs and not feel like they are merely playing a game of catch and release with the perps and felons who run free in the streets.&lt;/div&gt;</description>

      <description>&lt;div&gt;Assembly Bill 2062 made it out of appropriations and is to be voted on within the next two days.  Basically this bill (if approved) will limit all ammunition purchases to 50 rounds per month.  There will go any matches I plan on competing in... also, they'll make reloading as well as mail order illegal.  Someone saw the Chris Rock joke about making bullets more expensive (as a solution to crime) and took him literally.&#xD;
&#xD;
Making law abiding citizens pay for the deeds of criminals is never good policy.&#xD;
&#xD;
So, If you're in SF, Fiona Ma (415-557-2312) or Mark Leno (415-557-3013) are the reps you want to phone or message.  &#xD;

      <title>Sen. Perata unharmed in carjacking/ Sunday 12/30</title>

      <description>&lt;div&gt;Oakland -- State Senate President Pro Tem Don Perata was carjacked at gunpoint from his state car in North Oakland Saturday.&#xD;
&#xD;
Perata, 62, of Oakland was unharmed in the incident, which happened at about 1:45 p.m. as he was stopped in his state-leased red 2006 Dodge Charger at a red light at 51st Street and Shattuck Avenue.&#xD;
&#xD;
"It's nothing that I want anybody else to go through," Perata said Saturday. "It just happened so fast. It certainly ruins your day."&#xD;
&#xD;
Perata said he was waiting for the light to change when, out of the corner of his eye, he noticed a man walking up to him. The senator, who has campaigned against assault weapons and crime, said he mistook the man for a panhandler at first.&#xD;
&#xD;
But then the man began pulling a mask over his nose and pointed an automatic handgun at him "gangster style" - holding it sideways - before tapping it on his window and bellowing at him, "Get out of the m- car."&#xD;
&#xD;
"And after that, I just lost interest in his face and I just stared at the gun," Perata said.&#xD;
&#xD;
Perata jumped out of the car, which police say may have been targeted for its 22-inch rims. The man got inside and took off. He was followed by an apparent accomplice in a gold 2000 Chevrolet Camaro that had been stolen earlier Saturday, police said.&#xD;
&#xD;
The two cars got onto Interstate 980, and witnesses said they saw the cars exit on Park Boulevard from eastbound Interstate 580, said Oakland police Lt. Lawrence Green.&#xD;
&#xD;
Green said police believe at least two men were in the Camaro when it pulled up alongside Perata. The senator told officers that he believed he saw the men at a Union 76 gas station minutes earlier on Broadway Terrace, so it was possible that they followed him to 51st and Shattuck before carjacking him, Green said.&#xD;
&#xD;
Also taken was Perata's cell phone.&#xD;
&#xD;
Perata said he was preparing to get onto the freeway when he was carjacked. The gunman was no more than 3 feet away, and at one point, Perata said, he feared that if the assailant panicked and fired a round, "that would have been the end of me."&#xD;
&#xD;
The gunman was described as a black man in his late 20s, 5-feet-8, with a thin, muscular build, last seen wearing a black mask and dark clothing. Perata's vehicle has a state-exempt plate, 1166961, and the stolen Camaro's license plate is 5UBN288.&#xD;
&#xD;
"Sometimes the holidays bring out desperate times for people, and he did the safe thing and just gave up the car," said Perata spokeswoman Alicia Trost. "It's just unfortunate, but we're very happy that he's uninjured."&#xD;
&#xD;
Perata said he was grateful for the assistance of Oakland police officers, including Sgts. Todd Mork and Randy Bandino. &#xD;
&#xD;
Perata, who has campaigned against crime in Oakland and the East Bay, joked that he started the day at age 62 but now felt somewhere between 70 and 75.&#xD;
&#xD;
"I've been around this stuff for a while, but this is the first time I've ever had a gun pointed at me," said Perata, an Oakland Democrat who sponsored the assault weapons ban signed into law in 1999.&#xD;

From the attacks of 9/11 to Monday's school shooting, after every mass murder there is an overwhelming urge to "do something" to prevent a similar attack.&#xD;
&#xD;
But since Adam ate the apple and let evil into the world, deranged individuals have existed.&#xD;
&#xD;
Most of the time they can't be locked up until it's too late. It's not against the law to be crazy -- in some jurisdictions it actually makes you more viable as a candidate for public office.&#xD;
&#xD;
It's certainly not against the law to be an unsociable loner. If it were, Ralph Nader would be behind bars right now, where he belongs. Mass murder is often the first serious crime unbalanced individuals are caught committing -- as appears to be in the case of the Virginia Tech shooter.&#xD;
&#xD;
The best we can do is enact policies that will reduce the death toll when these acts of carnage occur, as they will in a free and open society of 300 million people, most of whom have cable TV.&#xD;
&#xD;
Only one policy has ever been shown to deter mass murder: concealed-carry laws. In a comprehensive study of all public, multiple-shooting incidents in America between 1977 and 1999, the inestimable economists John Lott and Bill Landes found that concealed-carry laws were the only laws that had any beneficial effect.&#xD;
 &#xD;
And the effect was not insignificant. States that allowed citizens to carry concealed handguns reduced multiple-shooting attacks by 60 percent and reduced the death and injury from these attacks by nearly 80 percent.&#xD;
&#xD;
Apparently, even crazy people prefer targets that can't shoot back. The reason schools are consistently popular targets for mass murderers is precisely because of all the idiotic "Gun-Free School Zone" laws.&#xD;
&#xD;
From the people who brought you "zero tolerance," I present the Gun-Free Zone! Yippee! Problem solved! Bam! Bam! Everybody down! Hey, how did that deranged loner get a gun into this Gun-Free Zone?&#xD;
&#xD;
It isn't the angst of adolescence. Plenty of school shootings have been committed by adults with absolutely no reason to be at the school, such as Laurie Dann, who shot up the Hubbard Woods Elementary School in Winnetka, Ill., in 1988; Patrick Purdy, who opened fire on children at Cleveland Elementary School in Stockton, Calif., in 1989; and Charles Carl Roberts, who murdered five schoolgirls at an Amish school in Lancaster County, Pa., last year.&#xD;
 &#xD;
Oh by the way, the other major "Gun-Free Zone" in America is the post office.&#xD;
&#xD;
But instantly, on the day of the shooting at Virginia Tech, the media were already promoting gun control and pre-emptively denouncing right-wingers who point out that gun control enables murderers rather than stopping them. Liberals get to lobby for gun control, but we're disallowed from arguing back. That's how good their arguments are. They're that good.&#xD;
&#xD;
Needless to say, Virginia Tech is a Gun-Free School Zone -- at least until last Monday. The gunman must not have known. Imagine his embarrassment! Perhaps there should be signs.&#xD;
&#xD;
Virginia Tech even prohibits students with concealed-carry permits from carrying their guns on campus. Last year, the school disciplined a student for carrying a gun on campus, despite his lawful concealed-carry permit. If only someone like that had been in Norris Hall on Monday, this massacre could have been ended a lot sooner.&#xD;
&#xD;
But last January, the Virginia General Assembly shot down a bill that would have prevented universities like Virginia Tech from giving sanctuary to mass murderers on college campuses in Virginia by disarming students with concealed-carry permits valid in the rest of the state.&#xD;
&#xD;
Virginia Tech spokesman Larry Hincker praised the legislature for allowing the school to disarm lawful gun owners on the faculty and student body, thereby surrendering every college campus in the state to deranged mass murderers, saying: "I'm sure the university community is appreciative of the General Assembly's actions because this will help parents, students, faculty and visitors feel safe on our campus."&#xD;
&#xD;
Others disagreed. Writing last year about another dangerous killer who had been loose on the Virginia Tech campus, graduate student Jonathan McGlumphy wrote: "Is it not obvious that all students, faculty and staff would have been safer if (concealed handgun permit) holders were not banned from carrying their weapons on campus?"&#xD;
&#xD;
If it wasn't obvious then, it is now.&#xD;

      <title>28.5 Truths and 1.5 Lie</title>

										&lt;div&gt;1. I was born in Manila, both my parents are Filipinos (my mom still has newspaper clippings of the event).&#xD;
2. I sailed from Hong Kong to the Philippines on a freighter named the "Don Antonio" (I thought it was named after me, but it was named for my grandfather).&#xD;
3. I first circled the globe as a bratty 2 year old with my mom and dad.  I got my first taste of Caviar from a Lufthansa Stewardess (I'm told that's where I got hooked on caviar as well as girls in uniform).&#xD;
4. My parents had poodles (a whole fleet of them) in Manila, my first pet was a sea turtle who swam in our coy pond.&#xD;
5. When I met (my governess) Aurora's fiancee, I punched him out (yeah, I was jealous back then).&#xD;
6. I still remember my family's first phone number in Urdaneta Village 887-234. My mom and Aurora taught it to me in case I got kidnapped.&#xD;
7. My first bicycle was a Schwinn, I had training wheels for months.&#xD;
8. I learned to ride a motorcycle in Bagyo when I was 8.  I think that Honda was my friend Ernie's.&#xD;
9. My dad bought me and my brother a Montesa motorcycle in Llavaneras, Spain when I was 9. I bought my own bike in Berkeley 9 years later.&#xD;
10. My family emigrated to the US in 1971, I was here on a Student Visa.  I got my green card in 87, citizenship in 99.&#xD;
11. My best friend growing up was named Anthony but I called him Tony.&#xD;
12. I quit drinking (the first time) when I was in the 6th grade.&#xD;
13. I was in the 8th grade when my dad bought me a .22 rifle.  My uncle followed suit with a 20 guage shotgun.  We used to go to Caslistoga to shoot skeet on a friend's ranch.&#xD;
14. My Aunt gifted me an amp for my first guitar, I still have the amp and it's LOUD!&#xD;
15. My first girlfriend's name was Betty.&#xD;
16. My first car was a green 1973 Mustang.&#xD;
17. I've been in more than 6 bands, all of them as guitarist except for the last two (bass and drums).&#xD;
18. I first smoked pot in the parking lot of a local Malibu Grand Prix. However, I first got really stoned in a dorm room in Santa Clara.&#xD;
19. I bought a car once for $30.  I sold it 2 years later for $50.&#xD;
20. My first day of work was washing dishes at an Italian restaurant on Taraval Street (I was filling in for my friend, Mark).&#xD;
21. My first real job was working at my dad's liquor store on 18th and Castro (when I turned 16, I started making deliveries for them driving a VW bus all over that part of town).&#xD;
22. I'm the product of a Jesuit education.  My first major in college was in Combined Sciences; I graduated with a Theatre Arts degree.&#xD;
23. I worked in Hollywood for about a year and a half after graduating from S.C.U.&#xD;
24. I got home sick (and was running out of money) and came back to SF and drove a tow truck for a few years before getting involved with production work in the Bay Area.&#xD;
25. Both my brothers married ex-girlfriends of mine.&#xD;
26. I've worked as a messenger for Lightning Express our boss encouraged us to go racing with him... I got hooked and left them for a job at Scuderia West.&#xD;
27. I raced motorcycles on the club level for 5 seasons, my fave track is Sears Point (Experian-whata?)&#xD;
28. I don't have a tattoo.&#xD;
29. I have 5 piercings (yet I only did 2 of them myself).&#xD;
30. I've been a firefighter since 1999.  I've lost track of how many fires I've fought.&lt;/div&gt;</description>

      <description>&lt;div&gt;After hearing Judge Warren's decision to strike down Prop H for being contrary to State Law, San Francisco officials sprung into action. &#xD;
&#xD;
Yesterday, City Attorney Dennis Herrera anounced that San Francisco will seek to appeal the ruling that PROP H's goal was an illegal disarmament of law abiding citizens.&#xD;
&#xD;
Proposition H would have forced all San Francisco residents to surrender their legally purchased and registered handguns. It would have also shut down the last remaining firearm retailer within city limits as another part of the proposition prohibits the manufacture and sale of all types of firearms and ammunition inside SF.&#xD;
&#xD;
All I want to know is; what brand of crack are they smoking in city hall?&#xD;

The Madera County District Attorney's Office announced Friday it will not seek criminal charges against Madera police officer Marcy Noriega for her role in the shooting death of Everardo Torres last October.&#xD;
&#xD;
Eric Wyatt, assistant district attorney, said an investigation determined Noriega did not intend to kill Torres.&#xD;
&#xD;
"Though this was a terribly tragic event, after reviewing all of the evidence, it is clear officer Noriega's shooting of Everardo Torres was an accident," Wyatt said. "In such a situation, California penal law is equally as clear. Mere general negligence is insufficient to sustain a criminal charge."&#xD;
&#xD;
Wyatt said criminal negligence is necessary to sustain a criminal charge and must go beyond "inattention, a mistake in judgment or a misadventure." It must be "an aggravated, reckless or grossly negligent act."&#xD;
&#xD;
Wyatt said results from a six-month investigation did not support criminal negligence. "Given the disastrous consequences of the events that occurred on Oct. 27, 2002, this decision was not reached quickly or without a tremendous amount of reflection."&#xD;
&#xD;
Torres, 24, was shot as he sat handcuffed in the back of a police cruiser after his arrest on charges of resisting and delaying police as they tried to quell a loud party at Madera Villa Apartments on North Schnoor Avenue. Noriega told investigators she intended to shoot Torres with her nonlethal Taser because he was kicking at the car's window, but that she accidentally used her service weapon.&#xD;
&#xD;
Torres died from a gunshot wound to the heart and liver that also pierced his right kidney, an autopsy revealed.&#xD;
&#xD;
A Taser shoots an electric charge that overrides the central nervous system and contracts muscles, momentarily incapacitating a person without causing permanent injury.&#xD;
&#xD;
On the night of the shooting, Wyatt said, a man sitting next to Torres in the squad car told investigators it was "accidental."&#xD;
&#xD;
Wyatt said the DA's office is aware the decision may create resentment and anger within the community. "While we understand these feelings, we cannot allow them to drive our decision," Wyatt said. "Obviously, if there was any issue of intent, this whole issue would have stopped with a murder case."&#xD;
&#xD;
It still is not clear whether Noriega, who has been on paid administrative leave since the incident, will return to work. Madera police will conduct an internal investigation now that the DA's office has ruled.&#xD;
&#xD;
"How long that will take or what the results will be, I don't know," Wyatt said.&#xD;
&#xD;
The Torres family, which has retained attorney Cameron Stewart of the Cochran Firm in Los Angeles, said they had no comment about the ruling. The reporter can be reached at lapadilla@fresnobee.com or 675-6805.&#xD;

disturbance handcuffed in the back of her patrol car. When the man &#xD;
started to kick at the car's windows, the officer decided to subdue him &#xD;
with her Taser. Incredibly, instead of pulling her stun gun from her &#xD;
belt, she pulled her service sidearm and shot the man in the chest, &#xD;
killing him instantly. The city, trying to protect its budget, says the &#xD;
killing is not the officer's fault, but rather "any reasonable police &#xD;
officer" could make such a mistake, slurring every police officer who &#xD;
actually paid attention to their training. The city filed suit against &#xD;
Taser, arguing the company should pay for any award from the wrongful &#xD;
death lawsuit the man's family filed against the cop. &#xD;
