performance test

The performance test makes me want to rip out my own eyeballs. If I hadn't gone on that tour of San Quentin, it would probably make me want to slit my throat, too. But we had to listen to some historian talk about the time some inmates kidnapped a guard and tried to slit his throat and apparently it's really difficult to slit a throat with a prison razor blade and we heard all about it in graphic detail.

If the 13th amendment expressly authorizes Congress to pass anti-discrimination laws, why did Congress instead use the commerce clause for the civil rights laws in the 1960s? Wouldn't it have been easier than arguing with a bunch of racists about whether a few heads of lettuce have an aggregate effect on interstate commerce? (I could have sworn we talked about heads of lettuce when we discussed that case in con law, but that was two years ago and maybe I'm confusing lettuce with sick chickens because there was also a case about sick chickens traveling in interstate commerce but I can't remember why the sick chickens mattered.)

I feel a bit better about bar prep after doing some of the constitutional law questions. Unlike torts, I seem to be able to answer more than 1/4 of these correctly. It's nice to know that there's at least one subject I kind of understand. Out of 12 or 13. It makes me want to run out and get a bumper sticker that says "I heart the dormant commerce clause" but I can't imagine where you could buy one.

I'm graduating from law school in less than two weeks. I should probably qualify that. I'm graduating from law school in less than two weeks if I get through three finals and finish a paper from last semester. Which means I'll be spending the next two weeks focused on (in no particular order) divorce, death, custody battles, greedy relatives, and the Eighth Amendment prohibition on cruel and unusual punishment. Isn't law school fun?

Boredom is a luxury. Unless you're in prison. I hate unjust enrichment. In more ways than one. All the songs I heard growing up don't mean what I thought they meant. Except some Phish songs. I still think "Let's Go Out to Dinner and See a Movie" means exactly what it sounds like.

We rejected the Teen Endangerment Act (aka parental notification), again. They're planning to put it back on the ballot, again, in 2008. You'd think the "pro-lifers" might figure out that the reason their initiative has lost twice is because Californians don't want a parental notification law. Sometimes, things are exactly what they seem. Nonetheless, the spokesman for "yes on 85" went on record claiming that 75 percent of Californians support parental notification. Prop. 85 (aka the "teen endangerment act") is supposedly really close. Please go out and vote NO if you haven't already. If the proponents really cared about the safety of California's teenagers, they'd do something about the conditions at the California Youth Authority, or about the lack of foster home placements for abused teens, or they'd try to improve our public high schools.

What are you doing for Halloween? I got an idea in school today when my professor drew an angel and a devil on the board. He was talking about a quote in an opinion by Justice Scalia, but I thought he was drawing Scalia and Stevens. I could dress up as Scalia with horns and a pitchfork, or as Stevens with wings and a halo. But I'm worried no one outside school would get it.

My big sewing project for the playa was going to be a long (fake) tiger fur coat with a lime green lining. I put it together a few weeks ago. I made it a *little* big so I'd be able to fit clothes under it. It turned out it was a *lot* big -- I probably could have wrapped it twice around myself. I basically started over, taking apart the coat and cutting the pieces 3 sizes smaller. It actually worked, lining and everything. I just need to finish sewing the lining to the fur and hem it and maybe put something down the front so I can close it (a long zipper or snaps or something). Now if only I could get my work done ...

Everyone is picking on me. I have a headache. I think I have a cavity but I couldn't get an appointment until the middle of September. I have way too much work to finish up tomorrow because I'm off next week (and back the following week, and then gone to Burning Man the week after that). I've spent way too much money on Burning Man already and I keep making clothes that I'm never going to get a chance to wear (if you're my size and you want to borrow something, come by Tha Hizzle).
